What Is Divorce in Australia?

Divorce is the legal end of a marriage. In Australia, it is a separate process from resolving property or parenting matters. To apply, you must meet certain eligibility criteria but you don’t need to have everything else finalised first.

If you’ve been separated for at least 12 months and your marriage has broken down irretrievably, you may be eligible to apply for divorce through the Federal Circuit and Family Court of Australia.

Who Can Apply for Divorce?

You can apply for divorce if:

• You and your spouse have been separated for at least 12 months.

• There is no reasonable chance of reconciliation.

• You or your spouse are an Australian citizen, live in Australia, or regard Australia as your permanent home.

• You can apply:

  • Individually (sole application) or

  • Together (joint application)
